General Terms & Conditions

General

1.1. These terms and conditions are part of every agreement and its execution, established via the Fish Tales webshop, where Fish Tales acts as the seller towards a buyer.

1.2. The Fish Tales webshop is part of Fish Tales NL BV, Nieuwpoortkade 2a, 1055RX Amsterdam.

1.3. The Fish Tales webshop offers services via the website for the sale and delivery of fish and related products throughout the Netherlands, except for the Wadden Islands.

1.4. Any general terms and conditions used by the buyer, regardless of their name, are expressly rejected and do not apply to this agreement unless these terms or specific provisions have been expressly accepted in writing by the seller.

1.5. Changes to the agreement between the seller and the buyer and deviations from these general sales and delivery terms will only be valid if they have been agreed upon in writing.

1.6. The Fish Tales webshop reserves the right to amend and/or supplement these General Terms & Conditions.

Definitions

2.1. The term "buyer" refers to any counterparty of the Fish Tales webshop, including natural persons, partnerships, companies, or legal entities that place an order via the website.

2.2. The term "Website" refers to the Fish Tales webshop available at www.fish-tales.com/shop.

2.3. An order consists of the goods listed in the concluded agreement.

Offers & Agreements

3.1. Offers or price quotations on the Website should be considered as invitations to potential buyers to make an offer. The Fish Tales webshop is not bound by such offers or price quotations, nor by any offer from potential buyers, unless explicitly and unambiguously confirmed in writing. Acceptance of an invitation to make an offer by the potential buyer constitutes an offer and only results in an agreement if the other conditions in this article are met.

3.2. An offer by the potential buyer is considered made in the following cases: the potential buyer has fully entered the required data on the designated order form on the Website and submitted them electronically to the Fish Tales webshop, and these have been received; or the Fish Tales webshop has issued a personalized quotation to the potential buyer, which has been accepted in writing.

3.3. An agreement is concluded when an order confirmation has been provided to the buyer, or, in case the offer was made via the Website, when an email confirmation is sent to the buyer's specified email address. The Fish Tales webshop reserves the right to revoke the agreement if the buyer does not meet the set conditions or has failed to meet them in the past.

3.4. All prices are in Euros, inclusive of VAT, as required by law. The buyer is required to pay the price stated in the confirmation as per article 2.3. Payment is required in advance. The Fish Tales webshop will not deliver products until payment has been received. Payments can be made via iDEAL or Credit Card.

3.5. Information, images, verbal statements, and product descriptions on the Website are presented as accurately as possible. However, Fish Tales cannot guarantee that all offers and products fully correspond to the provided information. Any deviations cannot be grounds for compensation or contract cancellation.

3.6. Obvious (manipulation) errors in pricing, such as apparent inaccuracies, can be corrected even after an agreement is established. Special offers are valid while supplies last.

3.7. Order costs may apply depending on the order value. These will be reflected in the total payable amount, inclusive of VAT.

3.8. If an ordered product is out of stock on the delivery day, the buyer will be informed via email or phone the day before delivery. If no products remain in the order due to stock issues, the buyer is entitled to a full refund. If only part of the order is unavailable, the buyer is entitled to a refund for the missing products.

3.9. Once an agreement is established per article 3.3, the buyer cannot modify or cancel an order.

3.10. Any additional orders are processed as new orders, with applicable order costs.

3.11. The cooling-off period of article 7:46d of the Dutch Civil Code does not apply, as these goods are perishable.

Force Majeure

4.1. The seller may suspend deliveries if circumstances prevent timely fulfillment, regardless of foreseeability at the time of contract conclusion.

4.2. If such circumstances occur, the seller may offer a new delivery date or cancel the agreement.

4.3. Force majeure includes, but is not limited to, war, civil unrest, terrorism, strikes, lockouts, fire, floods, governmental restrictions, supplier failures, and technical malfunctions beyond the seller’s control.

4.4. If force majeure prevents delivery, the agreement is considered dissolved, and the buyer is entitled to a refund.

Complaints & Liability

5.1. If the buyer receives defective products, they must report this immediately via webshop@fish-tales.com.

5.2. The buyer must retain defective products for at least five days and allow the seller to inspect or collect them if requested.

5.3. If a complaint is justified, the buyer is entitled to a refund for the affected products.

5.4. Fish Tales webshop is not liable for indirect damages, including business losses or personal injury.

5.5. Any claims against Fish Tales must be substantiated and proven.

Privacy & Data Protection

6.1. Personal data provided by buyers is treated with care and processed in line with Fish Tales’ privacy policy.

6.2. Buyers have the right to access, correct, or delete their data. Requests can be submitted via webshop@fish-tales.com.

Governing Law & Disputes

7.1. All agreements are subject to Dutch law.

7.2. Disputes will be settled by the competent Dutch court in Amsterdam.

Shipping Policy

Orders are shipped within 1 business day via PostNL.

Orders placed before 15:00 on a business day are processed the same day.

Buyers receive a Track & Trace link upon shipment.

Currently, we only ship within the Netherlands.

Shipping costs are calculated at checkout.

We collect identity, usage, payment, and communication data for order fulfillment and marketing.

Data is shared only with essential third parties (e.g., payment providers, logistics).

Buyers have rights to access, correct, delete, and restrict data processing.
